Tasty Gains Affiliate Program

Terms & Conditions

Effective Date: January 17, 2026

These Terms & Conditions (“Agreement”) govern participation in the Tasty Gains Affiliate Program (“Program”). By applying to, enrolling in, or participating in the Program, you (“Affiliate”) agree to be legally bound by this Agreement with Tasty Gains LLC, an Arizona limited liability company (“Company,” “Tasty Gains,” “we,” “us,” or “our”).

 

 

1. Eligibility

Participation is limited to individuals who are at least 18 years of age and able to enter into a legally binding contract. A valid tax identification number is required for payment purposes. Tasty Gains LLC reserves the right to approve or reject any application at its sole discretion.

 

 

2. Independent Contractor Status

Affiliates participate as independent contractors. Nothing in this Agreement creates an employment, partnership, joint venture, or agency relationship. Affiliates have no authority to bind Tasty Gains LLC to any obligation.

 

 

3. Promotional Conduct

Affiliates may promote Tasty Gains products using approved tracking links, discount codes, and creative assets provided through Social Snowball.

Affiliates are strictly prohibited from:

  • Making unapproved medical or health claims

  • Claiming FDA approval or endorsement

  • Misrepresenting product benefits, pricing, or results

  • Guaranteeing outcomes or transformations

  • Using deceptive or misleading advertising

  • Using the Tasty Gains brand name in domain names or social handles

  • Posting on illegal, hateful, or harmful platforms

  • Creating fake testimonials or reviews

Paid advertising is permitted, provided all ads comply with platform policies, FTC regulations, and Tasty Gains brand standards.

Tasty Gains LLC may require modification or removal of any promotional content at any time.

 

 

4. Legal & FTC Compliance

Affiliates must comply with all applicable laws, including but not limited to:

  • Federal Trade Commission (FTC) disclosure requirements

  • Advertising and consumer protection laws

  • Platform-specific policies (Meta, TikTok, Google, YouTube, etc.)

All affiliate promotions must clearly disclose the affiliate relationship using language such as:

“I earn a commission from this link.”
“Paid partnership with Tasty Gains.”
“Affiliate link.”

Failure to disclose properly constitutes a material breach of this Agreement.

 

 

5. Commission Structure

Affiliates earn a flat 20% commission on qualifying sales tracked through Social Snowball.

Commissions are only paid on:

  • Verified purchases

  • Non-refunded orders

  • Non-fraudulent transactions

Tasty Gains LLC reserves the right to reverse commissions for refunds, chargebacks, suspected fraud, or policy violations.

 

 

6. Payment Terms

Payments are issued Net 60 after the end of the month in which the sales are tracked.

Example:
Sales generated in January are paid by the end of March.

All payments are processed through Social Snowball. Affiliates are responsible for providing accurate tax and payout information and for reporting income to tax authorities.

Tasty Gains LLC is not responsible for payment delays caused by incorrect information.

 

 

7. Intellectual Property

All trademarks, logos, branding, product images, and marketing materials are the exclusive property of Tasty Gains LLC.

Affiliates may only use approved assets and may not:

  • Alter logos

  • Create counterfeit products

  • Sell on marketplaces without written authorization

  • Claim ownership of Tasty Gains intellectual property

All rights not expressly granted are reserved by Tasty Gains LLC.

 

 

8. Content & UGC License

By participating in the Program, Affiliates grant Tasty Gains LLC a royalty-free, worldwide, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, distribute, display, and create derivative works from any content submitted or created in connection with the Program for marketing, advertising, and promotional purposes.

This includes organic content, advertisements, testimonials, videos, and images.

 

 

9. Prohibited Activities

Affiliates may not:

  • Self-refer or manipulate orders

  • Use fake accounts, bots, or click farms

  • Offer unauthorized incentives

  • Spam or mass-message users

  • Violate platform rules

  • Mislead customers

  • Impersonate Tasty Gains LLC

Violations may result in immediate termination and forfeiture of unpaid commissions.

 

 

10. Termination

Tasty Gains LLC may suspend or terminate an Affiliate at any time, with or without cause.

Upon termination:

  • All promotional activity must cease

  • Affiliate links will be disabled

  • Unpaid commissions may be forfeited

 

 

11. Limitation of Liability

Tasty Gains LLC is not liable for any indirect, incidental, consequential, or special damages, including lost profits, data loss, or business interruption.

Participation in the Program is at the Affiliate’s own risk.

 

 

12. Indemnification

Affiliates agree to indemnify and hold harmless Tasty Gains LLC from any claims, damages, losses, or legal costs arising from:

  • Affiliate promotional content

  • Violations of this Agreement

  • Legal non-compliance

  • Misrepresentations

 

 

13. Modifications

Tasty Gains LLC may update these Terms & Conditions at any time. Continued participation constitutes acceptance of the updated Agreement.

 

 

14. Governing Law

This Agreement is governed by the laws of the State of Arizona, United States.
